THOUSAND DOLLAR GIVEAWAY CONTEST

RULES AND REGULATIONS

1. ELIGIBILITY: Open to United States residents who have reached the age of majority under the laws of the jurisdiction in which they reside at the time of entry. Jessta James, and their immediate families, advertising and promotion agencies involved in the Contest, the Contest sponsors, and all of their respective parent, subsidiary and affiliated companies are not eligible.

2. HOW TO ENTER: To enter the Jessta James’ Thousand Dollar Giveaway Contest participants must, during the period that begins at 12:00 A.M. MST on September 4th., 2019 and ends at 11:59 P.M. MST on November 4th, 2019 (“Contest Period”), visit the Jessta James website at http://www.jesstajames.com and:

- (A) purchase a digital download (mp3) of the song “Rainin” by Jessta James through the iTunes link via the Jessta James website.

- (B) Once the purchase has been made, participants must submit proof of purchase (a screenshot (picture) of their iTunes purchase, or a screenshot of their apple receipt), to the form provided on the Jessta James website. Participants must include their name and email address with submissions to qualify.

- (C) Share this link to your facebook timeline and tag three (3) friends.

- (D) Share this link to your Instagram profile and tag three (3) friends:

- (E) Each participants must provide (in 1 paragraph or less) their answer to the question: What does the message in the song mean to you?

All entries must be purchased and received during the Contest Period to be eligible to win a prize. There is no limit of entries per person. Any additional entries can be made with proof of ANY other Jessta James digital download (mp3) iTunes purchase, that is made during the Contest Period. Each download purchase qualifies one entry.

3. LIMITATION ON LIABILITY: By entering this Contest, entrants agree to be bound by these Official Rules and agree to release Jessta James Sponsors, and their employees, officers, agents and directors (collectively, the “Released Parties”), from any and all liability for injuries, losses or damages of any kind resulting from participation in this drawing and/or use or acceptance of any prize.

4. GENERAL CONDITIONS: The Contest is void where prohibited by law. Incomplete entries will be disqualified. The Released Parties are not responsible for any lost, late, misdirected, stolen or undelivered entries. The Released Parties are not responsible for technical, network, electronic, computer, hardware or software failures of any kind, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any materials in the Contest. The Released Parties are not responsible for incomplete entries. In the event that technical or other circumstances compromise this drawing, Jessta James reserves the right to cancel, modify or terminate the challenge, and the right, but not the obligation, to select winners for prizes from all eligible entries received prior to the cancellation. The Released Parties are not responsible for typographical errors in the Contest site or these rules. Jessta James reserves the right to share entry information with any other Released Parties.

5. WINNER SELECTION: Jessta James will select one winning entry on the first of every month. Each entry will be judged by the following:

50% Originality

25% Creativity

25% Content

The winner will be posted on the Jessta James Facebook Music Page http://www.facebook.com/jesstajames on the 7th of every month. Jessta James, whose decisions and interpretations of these Official Rules shall apply and be final and binding.

Winners will be notified via their contact information on the Jessta James web site. If a winner does not respond and meet the below requirements within 12 hours of attempted contact, Jessta James reserves the right to select an alternate winner. In order to receive a prize, winners may be required to sign an Affidavit of Eligibility, Liability Release and, where legally permissible, a publicity release, and may also be required to provide additional information (which may include, but not be limited to, social security or other tax information), waivers and releases. Winners will have one (1) business day to provide all such information and to execute and return the Affidavit of Eligibility, Liability Release and publicity release (if required by Jessta James). These documents will, among other things, release the Released Parties from any claims, losses, injuries or damages of any kind resulting from participation in the Contest or the use or receipt of any prizes, and allow the use of the winner’s name and likeness. Failure to comply with the foregoing, or the return of any prize or prize notification as undeliverable, may cause the winner to forfeit their prize and Jessta James reserves the right to select an alternate winner.

6. ADVERTISING: Except where prohibited by law or regulation, winner’s acceptance of prize will constitute permission for Jessta James, and the Sponsors to use winners’ name, likeness, and statements for any purpose in reference to the Giveaway and this promotion without additional compensation, consideration or consent.

7. PRIZES:

One (1) Grand Prize winner will receive: $1,000.

Approximate retail value of each Grand Prize is $1,000.

8. MISCELLANEOUS: Jessta James reserves the right to change or replace the prize at any time with a prize of equal or greater value. The prize is not transferable, nor assignable. All Federal, State and Local laws and regulations apply. Winners will be responsible for all Federal, State or other applicable taxes in connection with the receipt of prizes.

9. WARRANTY: Jessta James does not offer any warranty or guarantee; either expressed or implied in connection with this Contest or any prize. Any federal, state, or local taxes on prizes, and any other costs, fees or expenses not listed above are the sole responsibility of each winner.

10. RESERVE: Jessta James and Released Parties reserve the right to Extend or change the Contest dates for any reason. Jessta James and Released Parties reserve the right to cancel or withdraw from completing the Contest if the reserve of 1,000 digital downloads is not met.

11. GOVERNING LAW: LIMITATION OF LIABILITY: Entrants agree that the Contest shall be governed by the laws of the State of Montana and: (1) any and all disputes, claims and causes of action arising out of or connected with the Contest, the interpretation of the Official Rules, or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in the State of Montana (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, court costs; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by and constructed in accordance with the laws of the State of Montana.

12. CHALLENGE INFORMATION AND WINNER LIST: The Winner name will be available on the Jessta James website on or after the 7th of each month for at least 30 days thereafter.
